Pātimokkhā (luật giới  bản) chỉ đến tay chúng ta sau rất nhiều lần duyệt xét lại, một số lần duyệt xét được thực hiện bằng ngôn ngữ Ấn Độ, những lần duyệt xét lại khác được thực hiện bằng tiếng Tây Tạng hay tiếng Trung Hoa, chỉ có một lần bằng tiếng Pali vẫn còn là một truyền thống sống động, vẫn còn được tụng hai tuần một lần và cũng được chư vị tỳ khưu  theo Phật Giáo Nguyên Thủy tu luyện trên khắp thế giới. Đây chính là phiên bản duyệt xét được phiên dịch và được giải thích trong tập sách này.
Ý nghĩa thuật ngữ pātimokhā  hoàn toàn mang tính chất phỏng đoán. Theo tập Đại Phẩm (Mahavagga) từ này có nghĩa là “sự khởi đầu, là đầu (hay dẫn nhập – mukha),  là những phẩm chất thiện tuyệt hảo nhất (pamukha) trong số những phẩm chất trên đời này.” (Mv. II, 3.4) Thuật ngữ được sử dụng cho tên gọi không chỉ cho khoản luật cơ bản thuộc các giới luật, nhưng còn là một bài thuyết giảng uyên thâm. Đức Phật đã liệt kê những nguyên tắc căn bản chung cho các bài thuyết giảng của toàn bộ chư Phật, đó là: “không làm điều xấu, thực hiện điều thiện và giữ tâm ý trong sạch: đây chính là “thông điệp của chư phật (Dhp.183) Như vậy bất kỳ ý nghĩa từ nguyên nào của thuật ngữ pātimokhā  đều có nghĩa là một loạt những nguyên lý cơ bản dành cho việc tu luyện trong giáo pháp.
Bộ luật học cơ bản dành cho chư vị tỳ khưu, trong lần duyệt xét bằng tiếng Pali bao gồm 227 khoản luật được chia thành 8 mục phù hợp với hình phạt được gán cho từng khoản một: parajika: bất Cộng trụ; sanghadisesa: Tăng tàn; aniyata: bất định; nissaggiya pacittiya: Ưng xả đối trị; pacittiya: Ưng đối trị; patidesaniya: Ưng phát lộ; sekhiya:  Ưng học pháp; và adhikarana-samatha, cách giải quyết các vấn đề. Những hình phạt bắt nguồn từ khoản luật đi ngược lại với lỗi nói lời xúc phạm còn gồm cả lỗi vọng ngữ (dubbhasita) nữa. Còn đối với khoản luật Ưng học pháp (sekhiya), tập Phân tích (Vibhaṅga) khẳng định rằng không tuân bất kỳ khoản nào do thất lễ dẫn đến hình phạt dukkata (tức lỗi phạm tác ác) Tất cả những hình phạt phát sanh từ những khoản luật này có thể được xóa sạch thông qua hành vi thú tội (confession).
Tuy nhiên đã có những thời điểm khi mà các hình phạt được gán cho từng khoản luật lại không đủ sức mạnh để ngăn cản vị tỳ khưu tắc trách khỏi liên tục phạm phải một lỗi phạm nào đó. Trong những tình huống như vậy, Tăng Chúng vị tỳ khưu đang cư trú trong đó, sẽ chính thức áp đặt những hình phạt bổ xung lên vị đó như là cách để đem vị đó trở lại đúng đường. Những hành vi bổ xung chính thức này bao gồm từ việc tước đoạt  một số đặc quyền đặc lợi theo thâm niên, đến trục xuất khỏi Tăng Chúng đặc thù nào đó,  hay còn bị đình chỉ tham gia Tăng Đoàn chư vị tỳ khưu một cách toàn diện. Trong từng mỗi tình huống hình phạt này chỉ mang tính tạm thời; nếu vị tỳ khưu nhận ra lỗi lầm và sửa lại đường đi nước bước, Tăng Chúng phải thu hồi hành vi chống lại vị đó và phục hồi lại cho vị đó tình trạng trước.
Như vậy xét một cách toàn diện, hệ thống hình phạt của tập Giới Luật tận dụng ba nguyên tắc căn bản này – thú tội, tước đoạt mất và nhiều mức độ khai trừ khỏi Tăng đoàn khác nhau – như là những phương tiện đem thi hành các khoản luật đó, để hiểu được tính chất uyên thâm của hệ thống giới luật này, điều quan trọng là phải nhận ra được bằng cách nào từng mỗi nguyên tắc trong toàn bộ các khoản luật này có tương quan thế nào với việc tu tập Phật Pháp và việc tu tâm.
Thú nhận lỗi phạm (Confession): Có nhiều điểm trong các bài thuyết pháp (thí dụ như Ḍ2, M.140) trong đó  Đức Phật khẳng định, “Đây thực sự là tiến bộ trong việc nắm giữ giới luật của bậc thánh mà con người đó nhận ra một lỗi phạm của chính mình như là một lỗi phạm thực sự, sửa chữa lại lỗi phạm đó cho phù hợp với Phật pháp và chứng đạt kiềm chế trong tương lai.’  Từ bối cảnh mỗi khi  Đức Phật  đưa ra lời tuyên bố này, có điều rất rõ ràng là “tu sửa lỗi lầm” có nghĩa là thú nhận những sai phạm của mỗi người chúng ta. Trong đoạn văn khác, (M.61)  Đức Phật đã thông báo cho con trai của mình là Rahula  rằng nếu ta nhận ra những lời nói và hành vi của chúng ta gây hại cho chính mình và cho người khác, ta nên thú nhận những hành vi đó cho một người bạn có hiểu biết trong cuộc sống tu trì. Tất cả những ai đã tinh luyện được tư duy, lời nói và hành động của mình trong quá khứ, toàn bộ những ai sẽ làm như vậy trong tương lai, ngài nói thêm, đều đã hành động, đang hành động và sẽ hành động theo chính cách này. Thêm vào đó một trong những nhu cầu thiết yếu cơ bản để rèn luyện chính mình trong tu luyện đó chính là chúng ta không được thất trung hay lừa dối và chúng ta tự thú nhận với một người bạn có hiểu biết trong cuộc sống phạm hạnh phù hợp với hành vi đạo đức thực tế của mỗi người chúng ta (A.V.53). Như vậy lòng tự nguyện thú nhận những hành vi bất thiện của chúng ta là một yếu tố căn bản để chứng đạt tiến bộ nơi chánh pháp vậy.
Việc tước đoạt (Forfeiture): trong đa phần các tình huống, việc tước đoạt chỉ đơn giản là một điều phụ được thêm vào hành vi thú tội, chúng ta để mất quyền về một đối tượng đang được đề cập đến, ta thú nhận đã phạm phải tội nào đó và rồi nhận lại đồ vật đó. Tuy nhiên trong một ít tình huống trong đó vật đó không thích hợp cho một tỳ khưu để xử dụng hay sở hữu – ta phải phá hủy hay tước đoạt một cách vĩnh viễn. Trong những tình huống như vậy, việc tước đoạt lại được sử dụng như cách khiển trách chống lại tính tham lam và cũng là một nhắc nhở về hai nguyên tắc cơ bản đó là thỏa mãn với điều tối thiểu của mình cũng như tính có ít nhu cầu – đó là những điều tuyệt đối cơ bản trong việc tu luyện giới đức vậy.
Việc khai trừ (ostracism): Trong một đoạn văn nổi tiếng (S. XL.2),  Đức Phật nói với đại đức Ananda như sau, “Trở thành bạn tốt, được làm bạn lành, và là đồng nghiệp được  những người đáng khâm phục, chính là toàn bộ cuộc sống phạm hạnh vậy. Khi vị tỳ khưu đã trở thành người bạn tốt, đã trở thành bạn lành và là đồng nghiệp với những người đáng khâm phục, ta hy vọng vị đó sẽ tiến triển trên bước đường Bát Chánh đạo và tận dụng được rất nhiều điều từ tình bạn này.” Như vậy một trong số ít những điều vị tỳ khưu đang tu luyện một cách nghiêm túc tự nhiên sẽ là mối lo sợ sẽ bị khai trừ do những thành viên có tư cách đạo đức nghiêm chỉnh trong Tăng Chúng, vì điều đó sẽ trở ngại thực sự cho tiến bộ siêu nhiên vậy. Sự sợ hãi này có thể giúp ngăn cản ta không phạm phải bất kỳ hành động nào có thể dẫn đến khai trừ như vậy.
Theo cách này, hệ thông hình phạt của tập Giới luật cung cấp  sự phục hồi cho kẻ lỗi phạm và sự ngăn cản chống lại những lỗi phạm đó – với việc thú nhận là những phương cách phục hồi và việc khai trừ ngăn cản đó – khởi lên trực tiếp từ những nguyên tắc cơ bản đối với việc tu tập Phật pháp vậy.
Những lỗi phạm (offenses).  Trong việc phân tích các lỗi phạm nhằm mục tiêu ngăn cản các hình phạt, tập Phân tích (Vibhṅga) đã phân chia một hành vi thành năm yếu tố như sau: đối tượng lỗi phạm, nhận thức về lỗi phạm, ý định phạm phải lỗi phạm đó, cố gắng phạm phải lỗi phạm đó và kết quả lỗi phạm đó đem lại. Trong một số khoản luật cả năm yếu tố này giữ vai trò xác định được điều đó là một lỗi phạm thực sự hay không. Trong các tác phẩm khác chỉ hai ba hay bốn yếu tố đóng vai trò đó mà thôi. Thí dụ như  theo khoản luật Parajika cấm sát sanh, cả năm yếu tố phải có mặt để có được một lỗi phạm đầy đủ: đối tượng phải là một con người, vị tỳ khưu phải nhận ra con người đó, như là một sanh vật, vị đó phải có ý định sát sanh, vị đó phải cố gắng làm cho người đó chết và con người đó phải chết.
Nếu thiếu bất kỳ yếu tố nào trong số đó, hình phạt sẽ thay đổi, thí dụ như Đối tượng: nếu vị tỳ khưu giết một con chó, hình phạt chỉ là một tội Ưng đối trị (pacittya) mà thôi. Nhận thức: nếu vị tỳ khưu đó hỏa táng một người bạn, nghĩ rằng người bạn đó đã chết, sau đó ngay cả nếu người bạn đó thực sự vẫn còn sống nhưng lại bị hôn mê một cách nghiêm trọng, vị tỳ khưu đó không phải gánh chịu hành phạt nào. Ý định: nếu vị tỳ khưu đó tình cờ ném một hòn đá vào một người đang đứng ở phía dưới, tỳ khưu sẽ không phải gánh chịu bất kỳ hình phạt nào nếu người đó chết. Cố gắng: nếu vị tỳ khưu nhìn thấy một người ngã xuống sông, nhưng lại không cố gắng cứu người đó, vị tỳ khưu không phải gánh chịu hình phạt nào ngay cả người đó có chết đuối. Kết quả: nếu vị tỳ khưu đó có giết một người, nhưng chỉ mới có làm cho người đó bị thương mà thôi, vị đó phải gánh chịu một Thullacaya (trọng tội).
Có một số khoản luật mặc dù có các yếu tố ý định, nhận thức và kết quả trong đó lại chẳng có khác biệt nào để xác định những lỗi phạm cả, thí dụ như, nếu một vị tỳ khưu đang nằm ngủ một mình trong căn phòng và có một phụ nữ đi vào phòng rồi nằm ngủ trong đó với ngài, vị tỳ khưu đó phải gánh chịu hình phạt Ưng đối trị (pacittya) vì đã nằm trong cùng một trú xứ với một người phụ nữ ngay cả ý định của ngài là nằm ngủ một mình và không ý thức được sự hiện diện của người phụ nữ này. Vị tỳ khưu uống phải một ly rượu, nghĩ rằng ly rượu đó chỉ là ly nước ép trái nho, vị này phải gánh chịu hình phạt Ưng đối trị (pacittya) vì đã sử dụng những chất gây nghiện cùng một lúc. Một vị tỳ khưu dọa dẫm một vị tỳ khưu khác phải gánh chịu hình phạt ưng đối trị (pacittya) bất kể vị kia thực sự có bị hoảng sợ hay không.
Một khác biệt nữa là trong các khoản luật đó, vị tỳ khưu có  thể đóng vai trò thụ động trong khi phạm phải một hành vi có thể chu tất được yếu tố cố gắng, yếu tố ý định được biến đổi thành ưng thuận:  sự ưng thuận trong thâm tâm liên quan đến hành vi được phối hợp với cách diễn tả thể chất hay lời nói sự ưng thuận  đó. Với một số khoản luật như thế khoản luật chống lại giao cấu dâm dục chỉ đơn giản để cho hành vi đó tự động diễn ra cũng được coi như là ưng thuận thể chất ngay cả nếu ta nằm hoàn toàn bất động, và câu hỏi khởi lên ở  đây là liệu ta có phải gánh chịu một hình phạt hay không tùy thuộc hoàn toàn vào tâm trạng của ta. Lại có một số khoản luật khác, bao gồm những tình huống chống lại cuộc gặp gỡ dâm dật với một phụ nữ, bao gồm cả những tình huống người phụ nữ là tác nhân thực hiện cuộc gặp gỡ đó – đơn giản nằm yên bất động không đủ để coi là dấu hiểu thể chất ưng thuận và ngay cả nếu ta đồng ý trong thâm tâm, giả dụ như, với sự vuốt ve của người đàn bà đó, thời ta phải gánh chịu hình phạt chỉ khi nào ta nói lên điều gì đó hay đáp lại cử động thể chất với điều người phụ nữ đang làm. Yếu tố cố gắng là cơ bản cho mọi khoản luật và cũng được sử dụng để xác định các lỗi phạm trong những tình huống vị tỳ khưu có ý định vi phạm một khoản luật nhưng lại không hoàn thành hành vi của mình. Thí dụ như trong tình huống lấy của người khác, những cố gắng liên quan được nói đến để bắt đầu khi hành động với một ý định lấy cắp, vị tỳ khưu đó mặc đồ và bắt đầu bước gần tới đối tượng. Khi từng mỗi cố gắng ban đầu này – nói toạc ra, với từng bước đi – vị đó phải gánh chịu một dukkata (lỗi phạm liên quan đến hành vi sai trái). Ngay từ lúc đầu, điều này xem ra có vẻ hơi cực đoan, nhưng khi chúng ta nhìn kỹ vào tâm trạng  như là một sự quan trọng tột đỉnh, thời hệ thống gán ghép các hình phạt này thật là thích hợp. Trong những tình huống giống như vậy, nếu vị tỳ khưu hoàn tất được hành vi, những hình phạt vị đó phải gánh chịu  trong cố gắng lúc ban đầu coi như được vô hiệu hóa và vị đó được bỏ mặc với chỉ một hình phạt duy nhất do khoản luật đó áp đặt mà thôi.
Như vậy, đây là điều rất quan trọng, khi giải thích từng khoản luật học giới, là phải chú ý đến năm yếu tố này thủ vai trò gì trong việc xác định các lỗi phạm liên quan đến khoản luật. Và đương nhiên điều quan trọng đối với từng vị tỳ khưu là chú ý tới cả năm yếu tố này trong toàn bộ các hành vi để có thể chắc chắn rằng vị đó không rơi vào bất kỳ thời điểm nào của một lỗi pham. Đây chính là việc tu luyện giới luật  trở thành một phần công việc luyện tâm dẫn đến chánh đẳng giác. Vị tỳ khưu nào tỉnh giác phân tích các hành vi của mình liên quan đến năm yếu tố này, tỉnh giác trước năm yếu tố đó, khi khởi lên, và hành xử một cách nhất quán để có thể tránh không phạm phải bất kỳ lỗi phạm nào chính là vị đó đang tu tập ba phẩm chất tỉnh giác vậy; một thái độ phân tích những hiện tượng trong suy nghĩ, lời nói và hành động và việc kiên định trong việc loại bỏ những phẩm chất bất thiện và tu luyện những phẩm chất thiện ngay trong chính mình. Đây chính là ba yếu tố trong có thất giác chi tạo thành cơ sở cho bốn yếu tố còn lại đó là lạc, an, định và xả.
Trong khi duyệt lại năm yếu tố của tập Phân tích (Vibhṅga) để phân tích các lỗi phạm tập Phụ Tùy (Parivara) (VI.4) sáng tạo ra một số các phạm trù để phân loại các lỗi phạm, phạm trù quan trọng nhất chính là phân biệt được giữa các khoản luật mang theo một hình phạt chỉ khi nào cố ý phá vỡ các khoản luật đó thông qua nhận thức chính xác (sacittaka) và các phạm trù mang theo một hình phạt ngay cả khi không có ý phá vỡ  hay thông qua nhận thức sai lệch (acittaka).
Mặc dù không dễ dàng gì để áp đặc những hình phạt đối với những hành vi không cố ý, chúng ta phải suy nghĩ lại tâm trạng dẫn đến những hành vi như vậy. Đương nhiên trong một số hành động, ý định sẽ khiến cho tất cả sự việc đều khác đi giữa phạm lỗi và vô tội. Thí dụ như, xem thử một món đồ với ý định sẽ trả lại món đồ đó là điều hoàn toàn khác so với coi món đồ với ý định đánh cắp. Tuy nhiên có những hành vi khác với những hậu quả gây hại mà khi được thực hiện một cách vô ý thức, lại để lộ tính bất cẩn và thiếu thận trọng trong những lãnh vực một người có thể phải lãnh trách nhiệm về hành vi đó một cách hợp lý. Có nhiều khoản luật xử lý rất cẩn thận về tài sản chung và những điều cần thiết cơ bản của chúng ta lại rơi vào phạm trù này. Ngoại trừ một tình huống rất có thể sẽ không xẩy ra, mặc dù chẳng có khoản luật hệ trọng nào mang theo một hình phạt nếu ta phá vỡ khoản luật đó một cách vô ý thức, trong khi đó các khoản luật nhỏ lại mang theo những hình phạt như vậy rất có thể được coi như là những bài học bổ ích trong chánh niệm.
Tập Phụ Tùy (Parivara) (IV.7.4) cũng liệt kê sáu cách ta có thể phạm phải các lỗi phạm  như sau:
1)                 Vô ý thức, có nghĩa là  biết rõ hành vi đó đi ngược lại với các khoản luật, nhưng vẫn tiếp tục vi phạm bằng bất kỳ cách nào;
2)                 Không hay biết gì cả, có nghĩa là không nhận ra hành vi đó đi ngược lại các khoản luật;
3)                 Đãng trí;
4)                 Thừa nhận điều không thích hợp là  thích hợp, thí dụ, như uống một ly rượu vang lại cứ tưởng đó là ly nước táo ép;
5)                 Thừa nhận điều thích hợp là không thích hợp, thí dụ, như coi một ly nước táo ép mà cứ tưởng là ly rượu vang và rồi dù sao cũng uống ly rượu đó; và
6)                 Hành động mà không chắc chắc, thí dụ như không biết chắc nếu hành vi đó là thích hơp, nhưng vẫn tiến hành làm bằng bất cứ giá nào. Trong trường hợp này, nếu hành vi đó không thích hợp, ta bị xử lý theo khoản luật liên quan. Nếu hành vi đó hợp lý ta phải gánh chịu một hình phạt lỗi phạm liên quan đến hành vi sai trái trong bất kỳ biến cố nào vì đã hành động một cách tắc trách như vậy.   
Còn có một hệ thống  để phân biệt các lỗi phạm khác nữa được giới thiệu trong các tập Chú Giải cổ xưa chính là sự phân biệt giữa các khoản luật chỉ bị người đời phê phán (loka-vagga) và những lỗi phạm chỉ các các khoản luật phê phán (pannati-vagga) mà thôi. Tập Chú Giải định nghĩa cách phân biệt này bằng cách nói rằng các lỗi phạm loka-vagga do người có tâm trạng bất thiện mắc phải (có nghĩa là do tham, sân hay si ảnh hưởng) ngược lại các lỗi phạm pannati-vajja có thể lỗi phạm do những người có tâm trạng thiện. Những khái niệm này có thể được phát triển chủ yếu để xử lý những tình huống hết sức đặc biệt trong đó vị tỳ khưu có  thể do suy tính trưởng thành rồi mà phá vỡ một khoản luật – thí dụ như khi cuộc sống của một người khác có thể gặp lâm nguy. Trong những tình huống như vậy, đa số người đời không công kích gì kẻ lỗi phạm về hành vi của người đó, mặc dù các khoản luật có thể áp đặt một hình phạt nào đó.
Vì các khái niệm này cuối  cùng được hình thành trong các tập Chú Giải cổ xưa mặc dù đã trở thành một cách phân loại các khoản luật. Hình như các vị biên soạn cảm thấy một số các khoản luật nghiêm cấm những hành vi nhất thiết được thúc đẩy do tâm trạng bất thiện, ngược lại các khoản khác lại nghiêm cấm các hành vi có thể bị thúc đẩy do tâm trạng thiện. Đưa ra cách sử dụng cách phân loại này, tập Vinaya Mukkha tái định nghĩa các thuật ngữ này như sau đây:
            “Một số lỗi phạm chỉ là phạm lỗi bao lâu có liên quan đến người đời –là những điều sai trái và gây hại do những người bình thường không phải là tỳ khưu – những ví dụ có thể là ăn cắp, ăn trộm và sát sanh, cũng như những lỗi phạm nhỏ hơn như tấn công và nói những lời xúc phạm. Những lỗi phạm thuộc loại này được định nghĩa là loka vajja. Cũng có những lỗi phạm chỉ là phạm lỗi bao lâu có liên quan đến những qui định của  Đức Phật mà thôi – chẳng sai mà cũng chẳng gây hại gì cho ai nếu do những người đời phạm phải; và chỉ là điều sai trái khi do chư vị tỳ khưu phạm phải mà thôi. Dựa trên cơ sở chư vị đó đi ngược lại với những chỉ thị của  Đức Phật. Những lỗi phạm loại này được gọi là pannati-vajja.”    
Ngay cả chỉ nhìn lướt qua các khoản giới luật sẽ chứng tỏ cho thấy rằng rất nhiều khoản luật đó xử lý với loại lỗi phạm vừa đề cập đến ở trên, và những lỗi phạm như vậy tương đối chỉ liên quan đến các vấn đề nhỏ mà thôi. Vấn đề thường xuyên được nêu lên : Tại sao chỉ liên quan đến những chi tiết nhỏ mọn? Câu trả lời đó là: các khoản luật này xử lý các mối tương quan xã hội giữa chư vị tỳ khưu với nhau và giữa chư vị tỳ khưu với các đạo hữu người đời – và các mối tương quan xã hội này có vẻ như được định nghĩa bằng những điểm nhỏ mọn mà thôi.
Thí dụ như, có khoản luật qui định vị tỳ khưu không được dùng thức ăn nếu không phải là thứ thức ăn được chuyển cho ngài hay cho vị tỳ khưu đồng lưu do người đời không được thụ phong chuyển cho trong ngày đó. Khoản luật này có những phân nhánh thuộc phạm vi rất rộng. Trong số những điều khác khoản luật này có nghĩa là một vị tỳ khưu không từ bỏ xã hội loài người để sống cô lập trong một tu viện dành cho các vị ẩn sĩ  đi tìm kiến thực phẩm cho chính mình. Vị đó phải thường xuyên liên lạc với thế giới bên ngoài. Tuy nhiên ở mức độ tối thiểu và trong mối tương quan như vậy vị đó thực hiện công việc phục vụ tha nhân, ngay cả chỉ đơn giản cho ngài có cơ hôị thực hiện một vị dụ tốt về cách cư xử, và đem lại cho ngài cơ hôị tu luyện giới đức. Có nhiều khoản luật khác hầu như mang tính chất tầm thường như thể việc cấm không được đào đất và làm hại cuộc sống cây cối –  khi suy nghĩ kỹ càng sẽ bộc lộ những ý nghĩa một mục đích tương tự như vậy.
Những Tiêu Chuẩn Vĩ Đại. Mặc dù bộ Phân tích (Vibhṅga) và tập Khandhakas (Các Khoản Luật)  bao trùm một lượng lớn các tình huống, đương nhiên hai tác phẩm này không bao trùm được hết mọi sự kiện có thể xẩy ra trên thế gian này và từ những gì chúng ta đã thấy theo cách  Đức Phật đưa vào thành công thức các khoản luật – việc xử lý các tình huống khi các khoản luật đó khởi lên -  ta có lý do để nghi nghờ chính ngài mong muốn các khoản luật đó được hình thành một hệ thống khép kín. Còn đối với những tình huống không xẩy ra trong  khi ngài còn sống, ngài đã thiết lập bốn điều hướng dẫn sau đây để phán đoán – được gọi là Bốn Tiêu Chuẩn vĩ đại (một bộ luật tách biệt khỏi những gì ngài đã đưa vào thành công thức tại Bhoganagara) – để phân xử những tình huống không được  đề cập đến trong các khoản luật:
1.                 “Này chư vị tỳ khưu, bất kỳ điều gì ta không phản đối, tỷ như, ‘không được làm điều này,’ nếu điều đó khớp với những gì không được làm, nếu điều đó đi ngược lại với điều được phép làm, thời các ngươi không được làm điều đó.
2.                 “Bất kỳ điều gì ta không phản đối, tỷ như, ‘không được làm điều này’, nếu điều đó khớp với những gì được phép làm, nếu điều đó đi ngược lại điều gì không được phép làm, thời các ngươi được làm điều đó.
3.                 “Và bất luận điều gì ta không cho phép, tỷ như, ‘ Được phép làm điều này,’ nếu điều đó khớp với những gì không được phép, nếu điều đó đi ngược lại điều gì không được phép làm, thời các ngươi không được làm điều đó.
4.                 “Và bất luận điều gì ta không cho phép, tỷ như,  ‘Được phép làm điều này,’ nếu điều đó khớp với những gì được phép làm, nếu điều đó đi ngược lại điều không được phép làm, thời các ngươi được làm điều đó.” (Mv.VI,40)
Bốn tiêu chuẩn vĩ đại này, một khi được áp dụng đúng đắn, sẽ trở nên khí cụ quan trọng để triển khai rộng những nguyên lý giới luật  vào những tình huống chưa được thông suốt dưới thời  Đức Phật còn sinh tiền. Chúng ta sẽ có cơ hội tham khảo thường xuyên hơn trong suốt tác phẩm này.
Trong Luật (Canon) có bằng chứng cho thấy rằng chính thái độ của  Đức Phật liên quan đến giới luật không mang tính chất tuân thủ pháp luật một cách cứng nhắc, lấy ví dụ như bài thuyết pháp sau đây:
            “Đã có thời, Đức Thế Tôn còn đang ngụ trong thành Vesali, trong cánh rừng Đại Lâm. Lúc đó có vị tỳ khưu nọ tên là Vijjian đến gặp ngài … nói rằng: ‘Bạch Thế Tôn, có tới hơn 150 khoản luật học giới được nêu lên để tụng mỗi hai tuần trong tháng. Con không thể nào tu luyện hoàn hảo theo từng khoản đó được.’

                   “Vậy thì hãy cứ tu luyện theo đúng ba khoản học giới đó đi …khi nhà ngươi tu luyện để nâng cao giới … tuệ … định, nhà ngươi sẽ loại bỏ được tham … sân … si. Thế rồi khi nhà ngươi đã loại bỏ được tham, sân, si thời nhà ngươi sẽ chẳng làm điều gì bất thiện hay gian díu với bất kỳ điều gì xấu ác đâu.’
                   “Sau này, vị tỳ khưu đó đã thành công tu luyện nâng cao giới … tuệ … định …ngài đã loại bỏ hoàn toàn được tham … sân … si. Vị đó không còn làm điều gì bất thiện và không gian díu với bất kỳ điều gì xấu ác nữa.” (A. III.85).
Lại có bài thuyết pháp khác cũng đưa ra những điểm tương tự như sau đây:
                 “Này chư vị tỳ khưu, có hơn 150 khoản luật học giới các ngươi cần phải tụng hai lần hàng tháng, liên quan đến việc tụng  đọc đó những người trẻ ước muốn chứng đạt mục tiêu tự tu luyện chính mình. Có ba khoản học giới này trong đó bao gồm toàn bộ các khoản tu luyện khác. Ba khoản nào vậy? Đó là khoản học giới để nâng cao giới đức, khoản học giới để nâng cao trí tuệ và khoản học giới để nâng cao nhận thức (tức nâng cao giới, tuệ, định). Ba khoản học giới này bao gồm toàn bộ các khoản học giới khác ….
                 “Này Chư vị tỳ khưu, có tình huống vị tỳ khưu kia hoàn thành tu luyện trọn vẹn giới, tuệ, định (có nghĩa là đã chứng bậc Ứng Cúng.” Liên quan đến những khoản học giới nhỏ hơn và ít quan trọng hơn, vị đó mắc lỗi phạm các khoản đó và rồi tự mình phục hồi lại được. Vì lẽ gì vậy? Vì ta chẳng bảo đó là điều không thể làm được. Nhưng vì đối với các khoản học giới căn bản cho cuộc sống bậc thánh và thích hợp với cuộc sống bậc thánh đó, thời giới đức vị đó trở nên kiên định và vững vàng. Sau khi đã tu luyện các khoản học giới này, vị đó tiếp tục tu luyện các khoản giới luật khác. Bởi lẽ đã kết thúc được toàn bộ những phần nhánh tâm linh đó sao, vị đó chứng ngộ giải thoát và định giải thoát giúp vị đó thoát khỏi mọi phần nhánh tâm linh sau khi đã tuệ tri và chứng giới, tuệ, định cho chính mình ngay trong hiện tại này …
               “Những ai chỉ hoàn tất được một phần cũng chỉ chứng một phần mà thôi; kẻ nào hoàn tất được toàn bộ cũng chứng đạt toàn bộ các khoản học giới này. Ta nói với các ngươi, những khoản học giới này quả không vô ích đâu.” (A. Ý niệm trụ trì có nghĩa gìn giữ, bảo quản, trông coi ngôi Tam bảo, trụ trì cũng có nghĩa là săn sóc, nuôi dạy Tăng chúng trong một ngôi chùa. Phật giáo Nguyên Thuỷ xưng hô trụ trì bằng sư Cả, nghĩa là người trưởng thượng, vị thầy lớn nhất trong một ngôi chùa. Người Khmer xưng hô trụ trì bằng danh từ “chaoatthika”. Ngày xưa trụ trì thì được quần chúng ở một làng xã hay tăng chúng ở trong bổn tự suy cử lên làm trụ trì, nhưng ngày này Giáo hội ta quan niệm trụ trì phải có quyết định bổ nhiệm mới chính thức là người đại diện Tăng ni hướng dẫn Phật tử tu học đúng chánh pháp. Trong bài viết này, chúng tôi chỉ giới thiệu một vài điểm về BÍ QUYẾT VÀ NGHỆ THUẬT TRỤ TRÌ THEO PHẬT GIÁO
1. BÍ QUYẾT TRỤ TRÌ:
Trong phần này, chúng tôi giới thiệu một số bí quyết khi làm trụ trì. Bí quyết ở đây chúng tôi ám chỉ là Tăng sai, cũng có nghĩa phước đức của chúng ta. Nếu không có hai yếu tố này chúng ta khó trở thành trụ trì đúng nghĩa.
a/  TĂNG SAI:
Tăng có nghĩa là đoàn thể trong chùa hoặc trong Giáo hội, nhận thấy một vị tăng nào đó đủ tư cách, đủ đạo đức suy cử vị đó làm trụ trì, làm sư cả để hướng dẫn Tăng ni tu học. Thông thường một vị trụ trì tốt phải là vị cao hạ, có văn hoá, có đạo đức, giao tế tốt, đồng thời vị đó phải do Tăng bầu. Nếu không thì vị trụ trì sẽ khó thành công, vì không đoàn kết, không nhất quán, làm trụ trì mà tăng không tôn kính, dẫn đến chia rẽ, đồng thời sẽ dẫn đến nhiều hệ quả bất lợi cho việc phát huy ngôi chùa. Trong kinh tạng pali Tăng không đoàn kết sẽ dẫn đến bất hạnh cho Chư thiên và Nhân loại. Tăng ở đây ám chỉ là Giáo hội, cũng có nghĩa là ám chỉ Tăng chúng trong một ngôi chùa.
b/  PHƯỚC ĐỨC:
Vị trụ trì đồng nghĩa với phước đức. Phước đức nhiều thì trụ trì chùa to Phật lớn, phước đức ít thì trụ trì chùa nhỏ Phật bé, đạo leo teo. Không có phước đức thì khó sanh làm người huống hồ chi làm trụ trì. Trụ trì xứng đáng để tăng chúng và phật tử lễ bái cúng dường hàng ngày. Như vậy trụ trì là có nghĩa Phước đức đời trước đã tạo, đời này vị trụ trì cần phải tạo thêm: hạnh bố thí, hạnh trì giới, hạnh tham thiền, hạnh cung kính, hạnh phục vụ, hạnh tuỳ hỷ, hạnh hồi hướng, hạnh thuyết pháp, hạnh nghe pháp, hạnh cải tạo tri kiến. 10 nhân tạo phước đức trên Đức Phật dạy trong kinh tạng pali, vị trụ trì thường xuyên phải tu tập trong đời sống hằng ngày, vì đó phước đức cho mình và cho Tăng chúng trong chùa.
c/ VAI TRÒ TRỤ TRÌ ĐÚNG NGHĨA:
Trong luật tạng Pali, trụ trì một ngôi chùa phải có 5 vị: Tổng trụ trì, trụ trì y phục, trụ trì vật thực, trụ trì chỗ ở, trụ trì thuốc men. Y phục, vật thực, chỗ ở và thuốc men là Tứ vật dụng của Chư tăng sử dụng trong đời sống tu niệm của tu sĩ Phật giáo. Những vị phụ trách mỗi phần như vậy làm giảm bớt sự khó nhọc của vị tổng trụ trì, đồng thời thể hiện tinh thần dân chủ, hài hoà, khách quan đối với đại chúng. Tổ chức đó có ngay từ thời Đức Phật còn sinh tiền. Nhưng ngày nay chúng ta cảm thấy lời dạy và tổ chức đó vẫn phù hợp với thời đại điện tử và khoa học. Những nước Phật giáo Nguyên thuỷ hình thức đó vẫn còn tiếp nhận và thọ trì đúng nghĩa. Tuy nhiên hình thức và tên gọi ở mỗi quốc gia có khác nhau, nhưng ý nghĩa và vai trò của nó không khác nhau.
d/  TỪ BI HỶ XẢ:
Bốn pháp này là trong 40 đề mục tu thiền định, một vị hành giả phải tu tập nhằm có khả năng chuyển hoá niềm đau nỗi khổ để có hạnh phúc và an lạc trong thiền môn. Trụ trì giống như cha mẹ. Đức Phật dạy: “cha mẹ luôn có lòng từ bi hỷ xả đối với con cái”. Cũng vậy, vị trụ trì phải có tâm từ bi hỷ xả đối với Tăng chúng. Chúng ta tu tâm từ, có nghĩa là đối trị tâm sân, nếu không có sân hận nhiều thì theo y khoa sẽ không mất phải căn bịnh tim. Chúng ta tu tâm Bi, có nghĩa là đối trị lại tánh độc ác và hung bạo, nếu không có tánh độc ác và hung bạo thì sẽ không bịnh gan. Chúng ta tu tập Tâm hỷ, có nghĩa là đối trị tánh nhỏ mọn và ích kỷ, nếu không có tánh nhỏ mọn và ích kỷ thì sẽ không có bịnh táo bón và đường ruột. Chúng ta tu tập tâm xả, có nghĩa là đối trị lại dính mắc và cố chấp, nếu người dính mắc và cố chấp nhiều sẽ bịnh cao huyết áp. Đức Phật dạy có 3 loại bịnh: bịnh do thời tiết, bịnh do vật thực, hai loại bịnh này có thể chữa trị bằng thuốc; loại bịnh thứ ba là bịnh Nghiệp- bịnh Tâm, bịnh này phải chữa trị bằng tâm, phải tu tập mới đoạn trừ.
2/ NGHỆ THUẬT TRỤ TRÌ:
Vị trụ trì phải có văn hoá, tư tuởng, đạo đức, đồng thời phải có nghệ thuật. Nghệ thuật là giao tế, tâm lý, khen che đứng chỗ, đa năng, văn hoá học thuật cao, phải hội họp thường xuyên.
a/ GIAO TẾ:
Phải giao lưu với các tôn giáo bạn, các hội đoàn trong xã hội, đáp ứng nhu cầu của nhà nước phát động phong trào, thăm viếng và đáp lễ các chùa chiền cùng tông môn hệ phái. Gặp gỡ và sử dụng đúng lúc, đúng chỗ những tầng lớp trí thức và văn nghệ sĩ trong xã hội. Trong chùa phải đoàn kết 4 hội chúng: Tăng, Ni, Nam và Nữ cư sĩ. Tục ngữ có câu: “một cây làm chẳng nên non, ba cây chụm lại lên hòn núi cao”. Đạo Phật nhìn vạn vật với lý duyên khởi, cuộc sống xung quanh chúng ta sẽ nhìn với lý trùng trùng duyên khởi. Chúng ta thành công thì phải kết hợp những thành phần xung quanh chúng ta thì thành công của chúng ta mới có ý nghĩa và vững chãi. Ghế ngồi phải có bốn chân, nếu thiếu một chân chúng ta sẽ té bất cứ lúc nào.
b/ TÂM LÝ: 
Bản chất của Sa môn là Giới luật và đạo đức. Đạo đức thường khô và nguyên tắc. Cuộc sống nguyên tắc quá thì trở nên lập dị và sẽ xa dần với thực tế. Giới luật truyền thống là tiếp xúc phái nữ không được cười, ăn uống có ngon và dỡ không được khen chê v.v… Vị trụ trì mà sống nguyên tắc quá, thiếu tổ chức chắc chắn ngôi chùa đó tăng chúng và phật tử sẽ ít đi. Do đó yếu tố tâm lý trong đời sống vị trụ trì phải có. Tâm lý là biết người ta thích và không thích điều gì, tâm lý là sống với bản chất thật của mình, tức là cười, nói một cách chân thật. Gặp gỡ, tiếp xúc, nói chuyện là để lại hình ảnh đẹp, cử chỉ trong sáng, phong cách dung dị, những bài học đáng giá cho đối phương. Vị trụ trì không nên ích kỹ nụ cười, ánh mắt của mình đối với đại chúng, vì đó là biểu lộ sự trìu mến.
c/ KHEN CHÊ ĐÚNG CHỖ:
Khen thì ai cũng thích, còn chê thì ai cũng ghét. Bậc trí tuệ xem người nào chê mình đúng chỗ đó là bậc thầy của mình. Trong cuộc sống nhân vô thập toàn, ai cũng có lỗi, điều quan trọng là phải thấy lỗi và sửa lỗi của mình. Vị trụ trì sử dụng nghệ thuật khen và chê đối với đại chúng như là pháp môn tu giữa đời thường. Vị trụ trì khen không đúng chỗ và đúng người xem như là tai hoạ cho người được khen. Nếu khen đúng người và đúng chỗ thì lợi ích và hữu dụng cho người được khen. Chê cũng thế.
d/ ĐA NĂNG:
Đa năng là nhiều nghề, nhiều phật sự, nhiều chức vụ ám chỉ người có tài và đức, vì có tài và đức nên mới trở thành trụ trì đa năng. Vị trụ trì ngoài việc giới hạnh và vị tu sĩ trang nghiêm cần phải có thêm những nghề phụ: như thầy địa lý, tử vi, tử bình, bốc dịch, tướng pháp, thầy thuốc, thầy dạy võ, thậm chí phải thông thạo vi tính trong thời đại ngày nay. Ở chùa nên thành lập nhiều phân ban trực thuộc chùa như : từ thiện, hộ niệm, phòng phát hành kinh sách, ban ấn tống, câu lạc bộ thơ văn, câu lạc bộ văn nghệ, gia đình phật tử v.v….. để quy tụ các giới trong xã hội, phụ giúp và đẩy mạnh những khuynh hướng phát triển mái chùa mà vị trụ trì đang điều  hành.
e/ VĂN HOÁ HỌC THUẬT CAO:
Vị trụ trì cũng cần phải có văn hoá và trình độ học vấn cao để tầm nhìn và chiến thuật của mình đối với tăng chúng khoáng đại và thông thái hơn. Trụ trì là người đẻ ra những kế hoạch và phương pháp, văn hoá, giáo dục, từ thiện, xã hội v.v… để phát huy ngôi chùa. Do đó đòi hỏi trình độ học thuật cao. Trong Phật giáo có 3 loại trí: trí văn, trí tư, trí tu.  Trí văn và tư đòi hỏi phải có trình độ và học thuật. Ngày nay phải có cử nhân, thạc sĩ và tiến sĩ. Vì những văn bằng đó mới đủ trí tuệ để cống hiến cho đạo pháp và dân tộc. Càng có văn bằng cao thì nhìn tăng chúng tu học với ánh mắt hoan hỷ và trìu mến.
f/ PHẢI HỘI HỌP THƯỜNG XUYÊN:
Chùa là một tổ chức, nhân sự đến từ nhiều tỉnh thành khác nhau, không có bà con thân thuộc. Xuất gia sống chung với nhau, lấy giới luật làm nền tảng tu hành, kính trên nhường dưới. Thường có tổ chức thì phải có xung dột, hiểu lầm v.v… Những trường hợp này phải có hội họp thường xuyên để giải quyết. Trong giới luật, Đức phật cho phép 1 tháng có 2 lần làm lễ Bố tát. Bố tát là hình thức ôn lại giới luật của vị Tỳ kheo để sám hối, đồng thời ngồi lại với nhau để giải quyết xung đột và mâu thuẩn của Tăng chúng. Do đó vị trụ trì nên áp dụng phương pháp này, ngoài 2 ngày bố tát, còn phải tổ chức nhiều lần hội họp để giải quyết những vấn đề trong Tăng đoàn.
C. KẾT LUẬN
Trong kinh điển Pali, Đức Phật dạy: “Có 4 hạng người dễ sa đoạ khổ cảnh: Cô gái đẹp, vị vua, ông quan, vị trụ trì”. Tại sao? Vì những hạng người này có quyền, có sắc, nên đôi khi sử dụng quyền và sắc của mình không đúng Phật Pháp, không đúng nhân quả nên dễ sa đoạ khổ cảnh. Nơi đây Đức Phật sử dụng danh từ “Dễ”, chứ không có sử dụng danh từ “Sa đoạ”. Vị trụ trì có nghĩa là vị Bồ tát, là chư thiên tại thế. Nếu vị trụ trì biết áp dụng pháp luật trong đời sống thiền môn thì đúng nghĩa là Bồ tát và Chư thiên, nếu không thì dễ sa đoạ khổ cảnh. Điều các vị trụ trì lưu ý, giới luật Tỳ kheo nếu phạm 4 bất cộng trụ thì không còn là Tỳ kheo nữa, bốn bất cộng trụ: Sát sanh, trộm cắp, tà dâm, phe pháp cao nhơn.
